Cancellation Cheating by Cleartrip (Trip id 1307100353)

I had booked a hotel from cleartrip but due to unforeseen circumstances had to cancel it (Trip id: ):
1) I cancelled the booking 6 days prior to my checkin
2) The terms were a little vague ..so I called up customer care and they said that I will get the ENTIRE amount refunded.
3) After that I got a mail from cleartrip (around a week after cancellation) to check with my bank as the money was refunded. NO money had come
4) I mailed to cleartrip and they said they will get back to me
5) After a month almost I get a mail that I will get NO money back and a WRONG cancellation policy was pasted
6) When I brought to the notice the original cancellation policy, I got another bullshit response...

ORIGINAL POLICY:
If you cancel within 5 day(s) before checkin, you will incur 50.0% of your total stay. If you cancel between 5 day(s) and 10 day(s) before checkin, you will incur 100.0% of your total stay.

After a month CLEARTRIP refused to pay and pasted this policy:
If you cancel within 15 day(s) before check-in, you will incur 100.0% of your total stay. (i.e. entire amount paid by you would be deducted).

CLEARTRIP LAST RESPONSE (After I showed them the orginal policy):
1. If you cancel within 5 day(s) before check-in, you will incur 50.0% of your total stay plus Cleartrip cancellation charges of Rs. 300/- per booking.
2. If you cancel between 5 day(s) and 10 day(s) before check-in, you will incur
100.0% of your total stay (i.e. entire amount paid by you would be deducted).
Please note that, the word "incur" in this policy states the amount which would be charged.
Hence, as per above rate rules we regret to inform you that no refund is applicable from our end.

I was totally taken aback.
So this means had cancelled within 5 days, I would have got 50% of the money back... Because I was kind enough and cancelled earlier I will not get anything

Apart from this, I have all the mails stating that the money will be returned.

I WOULD RECOMMEND EVERYONE TO NEVER BOOK/CANCEL FROM CLEARTRIP.

Friends,
I have all the proofs, should I raise this in consumer court.

  1. You should definitely raise this to customer court. They are pretty active and will get you your rights.

  2. I can tell from my own experience... a similar harrowing experience happened with me with makemytrip, and I also had documentary proofs. I fought with them, and got my ENTIRE amount back. Trust me, these so called big companies think they can get away, but if one fights, they hide behind their own walls and then finally break down.

  3. What is making you wait for filing a case?? It is your hard earned cash and no one has the right to take it from you. The court is always kind towards the consumers and let me tell you one more thing that all legal cost incurred by you will also be given to you by the company. The judges will make this sure as well.

  4. Most of the time as soon as you send them a legal notice regarding the case, you will get the call from their side as well as refund as if proven guilty, the company has to pay penalty as well. And it is very clear in your case.
